These Terms & Conditions ("Terms") govern your use of the UptimePulse website and waitlist service. By joining our waitlist, you agree to these Terms. We've written them in plain language because legal jargon helps nobody.

1. What UptimePulse Is

UptimePulse is a unified observability and infrastructure monitoring platform currently in pre-launch development. By signing up for the waitlist, you are expressing interest in receiving early access — not purchasing a product or service.

2. Waitlist — What It Means

  • No purchase required. Joining the waitlist is completely free.
  • No guaranteed access. Waitlist position does not guarantee early access, beta participation, or account creation.
  • No guaranteed timeline. We are a small team building carefully. Launch dates, beta windows, and feature availability are estimates and subject to change without notice.

3. Pre-Launch & Beta Disclaimer

When UptimePulse becomes available, it may initially be offered as a beta or early-access product. During these phases:

  • The software is provided "as is" and "as available."
  • Features may be incomplete, change, or be removed without prior warning.
  • We do not guarantee uptime, data durability, or error-free operation during beta.
  • We may restrict, modify, or discontinue access at any time for any reason.

4. Acceptable Use

When joining the waitlist, you agree to:

  • Provide a valid, working email address. Disposable or throwaway addresses may be removed without notice.
  • Not submit the form repeatedly, use bots, scripts, or automated tools to sign up.
  • Not impersonate another person or entity.
  • Not use the waitlist for any unlawful purpose.

We reserve the right to remove waitlist entries that violate these rules.

5. Intellectual Property

All content on the UptimePulse website — including text, graphics, logos, code, and design — is the property of UptimePulse and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent.

6. Limitation of Liability

To the fullest extent permitted by law:

  • UptimePulse, its founders, and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the website or waitlist service.
  • In no event shall our total liability exceed the amount you paid to us — which, for the waitlist, is zero dollars ($0.00).
  • We are not responsible for any data loss, service interruptions, or security breaches that may occur during the pre-launch phase.

7. Third-Party Services

Our waitlist form is processed by Web3Forms. Your interaction with their service is governed by their own terms. We are not responsible for the practices of third-party services, though we select our partners carefully.

8. Modifications to These Terms

We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of the waitlist after changes constitutes acceptance of the revised Terms.

9. Termination

We reserve the right to remove any waitlist entry at our sole discretion, particularly if we believe the entry was created in violation of these Terms. You may also request removal by emailing support@flipcodex.com.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
